General Terms and Conditions of Hot Rod Citytour Berlin GmbH
1.) General Provisions
The rental of a “HotRod”—hereinafter referred to as the “Vehicle”—is conducted exclusively on the basis of the written rental agreement and these rental conditions, in accordance with German law. For any verbal collateral agreements to be legally effective, they must be incorporated in writing into the rental agreement.
The subject matter of the rental agreement is the provision of a Vehicle for the duration specified in the rental agreement. The rental price is determined by the price list, which forms an integral part of the rental agreement.
The Lessor reserves the right to refuse a rental without providing reasons.
2.) Booking/Payment
Once confirmed by the Lessor in text form, the booking of the Vehicle becomes binding; one or more Vehicles are thereby reserved for the Customer for rental on the agreed date. The Customer is obliged to pay the costs (rental fee) specified in the booking confirmation to the Lessor without delay. The rental agreement shall be concluded in writing on-site prior to the handover of the Vehicle.
The rental fee and the security deposit (payable in cash or by credit card) must be paid no later than immediately prior to the commencement of the drive. The Lessor is obliged to refund the security deposit following the return of the Vehicle, provided that the Vehicle is returned in accordance with the terms of the agreement. Should this not be the case, the Lessor is entitled to offset any incurred costs (e.g., damages, etc.) against the security deposit, or to retain the security deposit in full pending the clarification of such claims.
3.) Cancellation Policy
For Individual Bookings:
More than 48 hours prior to start – 100% refund
Between 48 and 24 hours prior to start – 50% refund
Less than 24 hours prior to start – 100% cancellation fee
For Group Events (e.g., Bachelor/Bachelorette Parties, Corporate Events, etc.):
More than 60 days prior to start – 100% refund
Between 59 and 30 days prior to start – 50% refund
Between 29 and 15 days prior to start – 25% refund
Between 14 and 0 days prior to start – 100% cancellation fee
4.) Special Notes / Use at Your Own Risk
The Renter is hereby advised that the rented vehicles are specialized vehicles. In terms of operation and handling, these vehicles are not comparable to standard passenger cars; consequently, even experienced drivers must familiarize themselves with their specific operation and handling characteristics. The Renter expressly accepts the heightened risks associated with these vehicles compared to standard road vehicles. Accordingly, use of the vehicles is undertaken at the Renter’s own risk. In particular, the Lessor shall not be held liable for any damages arising from risks inherent to the vehicles’ specialized design. The Renter is specifically advised of the following design-related peculiarities and risks:
– Due to their size, the vehicles are perceived as heavier than standard cars.
– The vehicle does not feature safety equipment typically found in modern cars—such as ABS, seatbelts, airbags, power brakes, or power steering.
– The vehicle is equipped with an automatic transmission and very direct steering (small movements of the steering wheel result in significant changes in direction).
– Unlike standard passenger cars, the brake must be operated with the left foot; furthermore, due to the vehicle’s design, the braking response differs from that of standard cars.
The Renter and any additional drivers are required to familiarize themselves with the operation of the vehicle and its specific characteristics *before* commencing the journey. This applies in particular to the vehicle’s steering and braking behavior.
Should any uncertainties arise, the Renter must consult the Rental Company or its staff during the vehicle handover and briefing session.
The Renter may not commence the journey until they have fully mastered the safe operation of the vehicle.
The Renter is further advised that the vehicles offer no protection against adverse weather conditions. The Rental Company assumes no liability for any damage or soiling caused by weather conditions.
5.) Vehicle Collection
Prior to collecting the vehicle, the Renter must present—in original form—the following documents for themselves and for all persons designated as drivers in the rental agreement:
– a valid identity card or passport;
– a valid driver’s license authorizing the operation of the vehicle (passenger car);
– a debit or credit card.
The vehicle is handed over to the Renter in a roadworthy, undamaged, and technically and visually flawless condition, with a full fuel tank and including all accessories (first-aid kit, safety equipment, etc.).
The Renter/Driver is obliged to report any complaints or discrepancies to the Rental Company at the time of vehicle collection and must ensure that these are documented in writing within the vehicle handover protocol.
At the time of handover, the Renter will receive instructions regarding the specific operating features of the vehicle. By accepting the vehicle, the Renter confirms that they have been sufficiently informed regarding the handling and operation of the vehicle.
